Re: "Dogma"

Dear Mr. Hinshaw:

We represent Bob Weinstein and Harvey Weinstein with respect to their interests in the motion picture entitled "Dogma." We are writing to express our serious concerns about the statements and positions taken by the Catholic League ("League") with the public.

Please be advised that "Dogma" is owned entirely by the Weinsteins in their personal capacities, and Miramax Film Corporation has no interest whatsoever in and to the film. We hope you are also aware that "Dogma" represents the creative vision of writer-director Kevin Smith, who is a practicing Catholic, and producer Scott Mosier.

We have reviewed the League's press releases dated April 5 and April 8, 1999. We fully recognize and respect the League's right to express its views concerning "Dogma," and we have no desire or intent to interfere with the League's freedom of speech and other rights. Likewise, we fully expect the League to respect not merely the same rights of our clients, but more importantly, the right of the public and the filmmakers to be free of any attempt to chill or interfere with their freedom of choice or expression. Films like "Dogma" that address issues of faith deserve no less freedom. What causes us concern about your public pronouncements is the suggestion that the League may endorse or induce unlawful restraints on the freedom of others to exercise their right to see and enjoy "Dogma." In particular, your April 8 press release states: "The Catholic League has a few buttons of its own to push, and we will not hold back." Statements like these may be interpreted to announce or imply an intention by the League to go beyond the bounds of legitimate and peaceful dissent or protest, and to stimulate, motivate, or incite danger or violence. Please be advised that any such impermissible activity authorized, committed, or encouraged by the League that harms or threatens harm to any person will not be tolerated. We intend to hold the League fully accountable for any wrongdoing, injury, or damage in causes.

We reiterate that we have no interest in curbing the League's right of free speech. But we will zealously and adamantly protect the rights of our clients and others to make this motion picture available to the public without impairment or infringement of their rights and without any fear or concern about their personal and physical safety.

We hope that you understand the spirit in which this letter is written. We trust the League will act responsibly and lawfully in all respect with regard to "Dogma."
